article 1 - purpose & acceptance of the general conditions of sale
1.1 PURPOSE
The present General Conditions of Sales (CGV) have for object, on the one hand, to inform any possible purchaser on the conditions and modalities in which the company Maison du Nougat (hereafter "the salesman") proceeds to the sale and the delivery of products. On the other hand, to define the rights and obligations of the parts within the framework of the sale of products by the salesman to the consumer (hereafter "the buyer").
All orders placed on the seller's website, accessible at the address: https: //www.maisondunougat.com (hereinafter "the site") are subject to these GTC. The seller reserves the right to adapt or modify these GTC at any time. In case of modification, the GTC in force on the day of the order will be applied to each order.

article 2 - products
2.1. SUPPLY AND AVAILABILITY OF PRODUCTS
Product offers are valid as long as they are visible on the site, within the limits of available stocks. If, despite the seller's vigilance, certain products are temporarily unavailable at the time of order confirmation, the seller will inform the buyer by email or telephone as soon as possible. The buyer may then modify or cancel his order. In the event of cancellation, the seller will proceed with the reimbursement within 14 days of payment. The seller will use the same method of payment as the one used by the buyer to make the refund.
2.2. PRODUCT PRICES
The applicable prices are those indicated on the site at the time of validation of the order. The prices are indicated in euros (€) and include all taxes (TTC). Prices are subject to the French Value Added Tax (VAT) applicable on the day of the order. The seller is free to modify its prices at any time.
article 3 - ordering process and payment conditions
3.1. ORDERING A PRODUCT
3.1.1 Product selections
To place an order, the buyer selects one or more products on the site, which are then added to his/her basket. The buyer can modify his/her basket at any time during the ordering process by adding or removing products from his/her basket. The "my basket" page summarises the products selected by the buyer, indicating the quantity and price of each. To continue the ordering process, the buyer must click on the "finalize my order" button.
3.1.2.Identification
The buyer is then directed to a page entitled "my customer account", on which the seller's identification details are reproduced. If the buyer has already placed an order via the site, he/she must enter the email address and password previously used in the box provided for this purpose. Otherwise, if the buyer is placing his or her first order, he or she must create an account by indicating his or her contact details: surname, first name, email address, postal address and telephone number. The buyer undertakes to provide the seller with genuine information. The buyer must also choose a confidential password specific to him. The seller reserves the right to refuse to open an account, to suspend its use or to delete it at any time if the information provided is inconsistent or incomplete. By communicating his contact details, and in particular his email address, the buyer accepts that the information exchanged between the parties may be done by email. By ticking the boxes provided for this purpose, the buyer may accept that his personal information be used for commercial prospecting purposes by the seller.
3.1.3. About the "your orders" page
After identification or after opening an online account, the buyer is directed to a page entitled "your order". On this page, the buyer's personal information, the billing and delivery address, the list of products to be ordered, their price, the delivery method (home delivery or relay point), the cost of shipping and the total amount of the order are summarised. The buyer is invited to read the present GTC. If they are acceptable, the buyer may continue with the order by ticking the box "I accept the General Terms and Conditions of Sale". Finally, at the bottom of the page, the different payment methods are proposed: by credit card or PayPal. To finalise the order, the buyer chooses the payment method of his choice, and will then be redirected to a page inviting him to enter his bank details. It is reminded that the confirmation of the order does not prejudice in any way the legal right of withdrawal during a period of 14 days from the day following the day of receipt of the goods by the consumer or a third party, other than the carrier, designated by him, for contracts for the sale of goods.
3.1.4. Confirmation of receipt of the order
An email confirming the order will be sent to the email address that the buyer will have previously provided when opening or creating his/her customer account. This email will summarise the following elements: the essential characteristics of the products ordered, the prices of the articles as well as the quantity, the delivery times, the cost of the delivery charges and information relating to the seller (identification, postal, telephone and electronic contact details).
3.2 METHOD OF PAYMENT
The buyer can choose between two means of payment to pay for his purchases:
By Visa or Eurocard/Mastercard bank cards: payment is made via the secure electronic payment platform of the company STRIPE.
Via a PayPal account: the customer connects to their personal PayPal account and enters their confidential information to make the payment.
article 4 - customer's right of withdrawal
4.1. RIGHT OF WITHDRAWAL
In accordance with Article L-221-18 et seq. of the French Consumer Code, the buyer has a withdrawal period of fourteen (14) days from the day following the receipt of the products purchased by the consumer or a third party, other than the carrier, designated by him/her, for contracts for the sale of goods. The buyer must inform the seller of his decision to withdraw by sending the withdrawal form, which can be downloaded by clicking here, or any other unambiguous statement expressing his wish to withdraw, to the postal and/or electronic address mentioned above, before the expiry of the above time limit. He must, where applicable, return all the products ordered to the seller within 14 days following communication of his decision to withdraw. The costs of returning the goods are to be borne by the buyer. In the event that the right of withdrawal is exercised, the seller is obliged to reimburse the full amount paid by the buyer using the same method of payment as the buyer. The reimbursement is due within a maximum of 14 days from the receipt of the returned products or the proof of the reshipment of the purchased products. The right of withdrawal cannot be exercised for contracts for the "supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection. Consequently, the product purchased whose packaging has been opened or damaged by the buyer cannot be subject to the right of withdrawal and cannot be refunded.
article 5 - data processing and liberties
5.1. RGPD PROVISION
By validating his/her order on the site, the buyer accepts that the seller collects personal data concerning him/her for the proper processing of his/her order(s). In application of the General Regulation on Data Protection (RGPD), the buyer has the right to access, modify, rectify and delete information concerning him/her at any time. To do so, the buyer must send a letter to the following email address: contact@maisondunougat.fr
The data collected will be kept for a period of two (2) years from the opening of the account.
